Subj: Coalition Files Federal Civil Rights Lawsuit Against Mayor and City On Monday, March 1, 2004, the Santa Teresa Citizen Action Group, Great Oaks Water Company, and several environmental leaders filed a long-awaited civil rights action against the City of San Jose, its city council and mayor, Ron Gonzalez, for attempting to exempt Calpine from over two dozen city planning and zoning laws in return for Calpine's payment of $6.5 million to City. The agreement requires the city to withdraw its opposition to the Metcalf Energy Center, and instead to actively support this power project, even though it violates over 30 environmental standards that the project would violate. The lawsuit, which was filed in federal district court in San Francisco, California, has been assigned to Federal Magistrate-Judge Bernard Zimmerman. The first hearing in the matter is scheduled for July 12, 2004. |
